An ICE Agent Fired Seven Shots Into a Car With a 5-Year-Old Inside. The Mayor Called Trump. It Didn't Help.

On the afternoon of October 8, 2026, Oscar Belgal picked up his 5-year-old son from school in the Marble Hill section of the Bronx. Minutes later, ICE agents in plainclothes and masks surrounded his car. What happened in the next moments is disputed in almost every detail except one: a single agent fired seven rounds into the vehicle, with the child still in the back seat. Belgal, 28, was hit in the neck and has spent the ten days since in a legal and medical limbo that has pulled in New York's mayor, its governor, the Bronx district attorney, and now the federal courts.

What happened, in the two competing accounts

There is no independent video that definitively resolves what triggered the gunfire. Here is what each side says.

ICE / DHS account

Belgal's lawyers' account

Agent identification

Agents identified themselves and gave lawful orders

Agents never identified themselves; wore masks and civilian clothes

What triggered the shooting

Belgal "weaponized" his vehicle, rammed two government cars, and accelerated toward agents

An officer smashed the car window and fired as Belgal tried to drive away, frightened

Shots fired

7 (confirmed by NYPD commanders)

7 (undisputed)

Belgal's background cited

Prior arrests for theft, robbery, grand larceny; open 2025 drug case; alleged Trinitarios gang member; subject of a Homeland Security Investigations probe

Has a prior conviction and an open, not-guilty 2025 drug case; neither charge was bail-eligible under NY law

A CCTV clip later obtained by the New York Post does not capture the alleged collision ICE describes. One witness told ABC7 New York that Belgal drove off because he was frightened. Unverified claims from a former neighbor, that Belgal had pulled a machete in an earlier altercation, have also circulated but are not corroborated in any official account.

The child

Belgal's 5-year-old son was in the back seat throughout the shooting. He was not physically injured and is now with relatives. DHS Secretary Markwayne Mullin said agents did not know a child was in the car. Mayor Zohran Mamdani rejected that as a justification, saying "no explanation exists for firing that many rounds" into a vehicle with a child inside.

From the street to the hospital to a federal detention center

  • Minutes after the shooting: NYPD officers arrived to find Belgal conscious, handcuffed, and surrounded by the plainclothes ICE agents. Police transported him to New York-Presbyterian Allen Hospital.

  • That evening: He was discharged at 9:58 p.m. and taken into ICE custody. Protesters, including elected officials, gathered at the hospital; five people were arrested there. Hundreds later rallied at Foley Square calling for ICE to be abolished.

  • The transfers: ICE moved Belgal to Delaney Hall in Newark, New Jersey, then to the Metropolitan Detention Center in Brooklyn. His lawyers say they could not locate him for nearly a full day during these transfers.

  • Friday, October 9: A federal judge barred the government from deporting Belgal and ordered he be held only in New York or New Jersey, pending a habeas corpus petition filed by his legal team.

  • That weekend: The Bronx District Attorney opened an investigation into the conduct of the agents who shot him.

  • October 15: Belgal appeared by video before an immigration judge. His lawyers said he still needs surgery to remove the bullet from the back of his neck, and that he is being held in solitary confinement on 24-hour lockdown with no phone access to his family. ICE has not honored a request to move him. His next immigration hearing is October 29.

The Mayor called the President. It didn't work.

New York City Mayor Zohran Mamdani said he spent two hours on the phone with President Trump personally trying to secure Belgal's release. He was unsuccessful. Mamdani has since said ICE "operates with impunity" in the city. Governor Kathy Hochul went further, publicly calling for a pause on all ICE enforcement actions in New York State and contrasting the agency with others, saying they "don't shoot into vehicles at all."

An important legal detail: the ICE detainer that was never honored

Belgal was already known to the legal system before the shooting: he had a prior conviction and an open 2025 drug case, to which he has pleaded not guilty. Neither charge made him eligible for bail under New York law, and an ICE detainer request on him was not honored under the state's sanctuary law, which generally bars local authorities from holding someone solely at ICE's request without a judicial warrant. That is part of why the agency pursued the arrest itself rather than through local custody, a pattern that has become more common as more states and cities limit cooperation with civil immigration detainers.

This is not an isolated incident

According to a review by States Newsroom of public reports and documents, Belgal's shooting is at least the 22nd time federal immigration agents have shot at someone since the start of the current administration in January 2025. Nineteen of those 22 incidents happened during vehicle stops. Separately, federal immigration officers have killed six people since January 2025, three of whom were US citizens, and four of the killings occurred during traffic stops.

Where the case stands right now

  • Deportation: Blocked by a federal judge's order, pending the outcome of Belgal's habeas corpus petition.

  • Criminal investigation: The Bronx District Attorney is investigating the agents' conduct; no findings have been announced.

  • Medical: Belgal's lawyers say he still needs surgery to remove a bullet from his neck and has not received it.

  • Detention conditions: His attorneys say he is in solitary confinement with no phone access to family, and that ICE has not acted on a request to move him.

  • Next court date: October 29, 2026, before an immigration judge.

Frequently asked questions

Was Oscar Belgal's child hurt in the shooting?

No. His 5-year-old son was in the back seat during the shooting but was not physically injured and is now with relatives.

Why hasn't Belgal been deported?

A federal judge issued an order on October 9, 2026, blocking his deportation while his habeas corpus petition is pending.

Are the ICE agents facing any consequences?

The Bronx District Attorney has opened an investigation into the agents' conduct. As of this writing, no charges or findings have been announced, and DHS maintains the agents acted lawfully because they believed their lives were in danger.

How common are shootings by immigration agents?

A States Newsroom review counted at least 22 shootings by federal immigration agents since January 2025, 19 of them during vehicle stops, with six fatalities including three US citizens.

What is an ICE detainer, and why wasn't it honored in this case?

A detainer is a request for local authorities to hold someone for ICE pickup. New York's sanctuary law generally bars holding someone solely on that request without a judicial warrant, which is why ICE made the arrest directly rather than through local custody.
